Original Title: Deputies of Hebei Provincial People's Congress Involved in Violence
Recently, dozens of men in the village of Anzhuang, Xian County, Hebei Province entered the village with steel knife sticks to ask for a credit union loan, which triggered a collective protest by the villagers. Villagers at the scene of the incident said that violent debt collection by idlers was not an isolated case in Xianxian, and abductions, beatings and intimidations occurred repeatedly. The reporter investigated that many debts of the Xianxian Rural Credit Cooperative had passed the statute of limitations and the law did not support it. Two years ago, the agency auctioned more than 40 million of its bad debts to a businessman in Hebei Province, who is also a representative of the Provincial People's Congress. The police have now been involved in the investigation and relevant personnel have arrived.
In the afternoon of November 9th, Liu Qingshan, a thin farmer, was "tied" at the entrance to the village. The moment the four strong men stuffed the peasant into the van, the villager Feng Shuhong, who was crouching in the village food store, decided to save people. He drank four or five villagers and rushed for the van.
However, this act did not achieve the goal, but instead led to the rescue of his rescue team. "As soon as we got to the van, we picked up five people holding machetes and picks." Another party said that everyone had to run to the village and chase the knife-holder behind.
"This situation has happened many times in Murakami." Yesterday, a villager said that there were still people who had their arms broken.
Debt collection encounters knife-closed villages
On November 9th, when Feng Shuhong ran into the village committee, he shouted to the village's broadcasting system, "The gangster rogue entered the village!" Next, hundreds of villagers rushed out from all corners of the village. They held sticks and forced the knife man back to the car. They shoved the fifth man away from the car, leaving a van with broken glass.
"Everyone has called the police, and they want the police to catch them." A villager recalled.
Subsequently, thirty or forty men with machete sticks poured in from the northeast corner of the village.
"The leader is Zhu Hongpo, who is a rude leader, I know." An Jingui, a villager lying in the hospital on November 15th, said that Zhu came in a white BMW. He got out and asked who just hit the van. "I said I smashed it, and wanted to make the big thing smaller and the little thing smaller. The other party didn't buy it. They slap me first and knock me down with a few sticks."
The doctor said that An Jingui suffered a soft tissue contusion and congested cysts.
An Jingui was beaten, which immediately triggered a beating between hundreds of villagers and men with swords. "They cut it with a knife, and we threw it with stones and clods." A villager who asked not to be named said that after a while the two police officers rushed in and couldn't help it. The two sides got red eyes and the villagers overturned Zhu Hongpo. White BMW car. Zhu's men cut and injured at least five villagers.
After the BMW car was overturned, more than a dozen men rushed into the village with a knife from the south. The villagers believed that the north-south pinch attack fully proved that the attackers were prepared.
"But we also have a way." The above villagers said that under the broadcast of the big horn in the village, the villagers who surged in like the tide quickly completed the anti-encirclement. "People let us run away, and they got their machetes and picks, and gave them to the police."
That night, An Jingui, who was the first to be beaten, was taken out of the village and forced to stop by two cars. This time, An Jingui was stuffed into the trunk of the car and pulled into the can factory of Nissin Group.
"They made me kneel, pressed my head under the wheel, and the belt was taken away, and beat in turns." An recalled that after he was stunned, the other person poured his own back with cold water, and woke up. .
An Jingui clearly remembers who kidnapped him, "It is the big man in our county called Zhu Jinglun." He recalled: At the Nisshin Group, Zhu pinched his neck and asked, "Do you know that, all It's my people. "
The reporter called Zhu Jinglun many times. I have been missed.
Famous businessman collecting debt
Zhu Jinglun is a household name in Xianxian.
According to public information, at the age of 46, he is the chairman of the private company Hebei Rixin Group. His six wholly-owned subsidiaries are involved in the bottle making, plastics, transportation, real estate, steel structure and other industries. It became the largest taxpayer in Xianxian County.
At the local authorities, Zhu's influence is also extraordinary. In 2003, Zhu Jinglun was elected as the representative of the 11th Cangzhou National People's Congress, and in 2006 was elected as the representative of the Cangzhou Annual People's Congress. In 2011, the Xianxian Civilization Committee recommended him as a "Cangzhou capable person" candidate. In 2013, he served as the representative of the Twelfth National People's Congress of Hebei Province.
Zhu Jinglun's men clashed with the villagers because the representative of the National People's Congress obtained a debt of 44.45 million yuan from the local rural credit cooperatives through auctions. The arrears of the villagers involved nearly a hundred people in seven or eight villages. Liu Qingshan was one of them.
For these loans, the villagers of the above-mentioned villages have recognized them. An Jingui said that around 2000, almost every household in the villages of Huai Town operated business and set up factories, and had more loans. In more than 600 households in Anzhuang, the number of loans reached over 100.
A local loan officer said that with the loss of benefits for farmers and industrial and commercial households, many villagers did not repay their debts, which led to an increase in the bad assets of local credit cooperatives.
After Zhu Jinglun accepted the debt of the credit union, violent debt collection appeared in the village. The villagers were frequently abused, harassed and even slashed by a debt collector. The villagers reported that in order to collect debts, Zhu's men wrote large dead letters with red paint on the walls of the debtor villagers. Some people's homes were sealed by four cars for eight days, and the villagers were abducted near the crematorium. Of the cornfield was told to "buy without paying back".
In addition to threats and intimidation, what concerns villagers the most is to use a knife and a car. In October, Wang Guangwei's son was forced to stop by a car while driving on National Highway 307. Four or five men put a machete on his neck and drove the Wang family's car to the can factory of Nisshin Group.
This encounter also happened to Wang Xiaolin (pseudonym) of Xiyang Village. On November 8, when Wang Xiaolin's colleague borrowed and drove his car, he was also forced to stop, the knife holder was around his neck, and the car was driven away by the urging officer.
For the accusations of the villagers, I wish I did not reply. A deputy general manager of his company, Wang, said that there were conflicts, but they were done by people below.
Difficulties of Rural Commercial Bank
Today, the Xianxian Rural Credit Cooperative Union has been transformed into a Xianxian Rural Commercial Bank.
Regarding the situation in which farmers did not pay back their accounts, Zhang Shuhai, the credit department of the Rural Commercial Bank of Xian County, said that the credit cooperatives had repeatedly asked villagers to make demands, but all returned without success. Many villagers in the four villages have said that the credit unions have never asked them to repay their loans.
However, relevant legal documents that can be found by reporters from the Beijing News show that before the restructuring, the Xianxian Rural Credit Cooperatives had settled loans through judicial litigation. Only a few of them began in 2013.
Guo Tianyong, a professor at the School of Finance at the Central University of Finance and Economics, believes that "the absence of a reminder is related to the relatively weak risk management capabilities of rural credit cooperatives."
A person in charge of a rural credit cooperative in Henan told reporters that the loan contract between Xianxian Rural Credit Cooperative and each villager was only tens of thousands of yuan, but there were thousands of borrowings. It ’s also a long time. "
A reporter's investigation found that many debts of the Xianxian Rural Credit Cooperatives in the villages of Huaizhen have been in debt for more than 10 years, and some were even 30 years ago.
According to the relevant provisions of the General Principles of the Civil Law, the limitation period for general debts is 2 years. Many debts of the Xianxian Rural Credit Cooperatives have exceeded the statute of limitations of the lawsuit.
Zhu Xiaoding, a lawyer at Beijing Cailiang Law Firm, said that after the statute of limitations, banks can still sue, but if the lender defends against this, the court will generally reject the bank's request.
Zhang Shuhai, a credit department of the Xianxian Rural Commercial Bank, said that the credit union would not be able to recover the case if it was not accepted by the court.
Dumping the bag for "selling" assets?
Prior to the restructuring, the Xianxian Rural Credit Cooperative Union auctioned non-performing assets in June 2012, of which 931 debts totaling 44.45 million yuan were transferred to the representative of the People's Congress of Hebei Province, Zhu Jinglun.
Zhu Jinglun was a shareholder of Xianxian Rural Commercial Bank after the credit cooperative was restructured. After accepting the debt, the market began to question such issues as the acquisition of non-performing assets at such a low price and the violation of procedures. The market believes that I wish the purchase price of this asset is 4 million, and has not undergone a public auction.
The reporter contacted Zhu Jinglun by phone and wished that he had not answered the phone.
The reporter went to the Xian County Banking Supervision Office to understand that officials from the Banking Supervision Office said that the Xian County Rural Credit Cooperative Union had auctioned in accordance with the "Interim Measures for the Transfer and Disposal of Non-performing Loan Credits of Rural Credit Cooperatives in Hebei Province".
The reporter went to the credit department of the Rural Commercial Bank of Xianxian after the restructuring. The ministry's Zhang Shuhai declined to disclose the auction price of the debt and did not provide an auction announcement. He said, "I don't know anything."
The original purpose of the Rural Credit Cooperative was to provide farmers with their own funds and help each other with their funds. However, most of the initial credit cooperatives came from the state, and farmers contributed only a small part. Around 2004, the central bank and local governments used large amounts of funds (the central bank took 165 billion) to pay for the shortfalls of credit unions.
An industry insider believes that without the release of 931 account details, Xianxian Rural Commercial Bank cannot know whether there is a profit transfer in the asset transfer.
According to a reporter's investigation, violent debt collection triggered by the auction of bad debts by rural credit cooperatives is by no means an isolated case across the country.
A person in charge of a provincial rural commercial bank in North China said that in order to avoid violent call for loans, some local banks have made some regulations, "For example, in Henan, even if the loan debt auction is transferred to others, bank personnel still need to accompany the call. Rather than corporate and social personnel to collect debt, to the greatest extent avoid violent debt collection. "
